The concentrated control of constitutionality of rules in the 1988 Constitution of the Federative Republic of Brazil

The Constitution of the Republic of 1988, the main source of all other normative species, is the basis of the entire national juridical framework, from which all other ‘species’ of laws derive their existence and validity. However, some normative species are already born unconstitutional, in their formal or material aspect. The purpose of this paper is to demonstrate the importance of controlling the primary and secondary normative acts emanated by the Public Power in relation to the Major Law, considering the need to protect the rights of citizens against unconstitutional acts that end up creating disruptions in the social order.
